Programs and publications offered by Manufactured Housing Communities of Oregon (MHCO) are intended to provide members with current and accurate information. However, such information may not be sufficient in dealing with a particular problem and MHCO does not warrant or represent its suitability for such a purpose. Individuals using MHCO publications do so with the understanding that MHCO is not engaged in the practice of law and does not render legal or accounting services, and that the information published by MHCO should not be relied upon as a substitute for independent research to original sources of authority.

MHCO Form 1 - Rental Application (Rev. 12/03)
The Rental Application form provides the basic information needed to make a decision on accepting the applicant. When used properly the Rental Application should provide adequate information in determining whether an individual qualifies to become a tenant in the community. The MHCO Rental Application requests information regarding employment and financial and rental history, as well as information regarding the home and vehicles. Most community owners prefer to use a professional screening company for credit checking and rental history verification. The costs involved are usually passed on to the prospective tenants.

MHCO Form 3 - Criminal Check Authorization (Rev. 12/01)
The Criminal Check Authorization form allows the prospective community to proceed with a criminal background check of the applicant. The form requests the applicant's name, social security number, drivers license number and current address. Most community owners prefer to use a professional agency for criminal background checks. The costs involved are usually passed on to the prospective tenants.

MHCO Form 5A - Manufactured Dwelling Space Rental Agreement/Dispute Resolution Addendum (Rev. 12/03) (Effective January 1, 2004)
The MHCO Rental Agreement is designed to meet the current requirements of Oregon State Law. The Rental Agreement, which is intended for use in all classifications of parks, can be changed or altered to suit individual situations. The Rental Agreement should be completed and signed by both the landlord and the tenant/resident prior to the home being moved into the community or prior to the tenant/resident occupying a home already sited in the community. Includes an addendum to the rental agreement for dispute resolution

MHCO Form 5B - Manufactured Dwelling Space Lease Agreement/Dispute Resolution Addendum (Rev. 12/03) (Effective January 1, 2004)
The MHCO Lease Agreement is designed to meet the current requirements of Oregon State Law. The MHCO Lease Agreement is intended for use in all classifications of parks.

MHCO Form 5C - Manufactured Dwelling Rental Agreement (Landlord is owner of Space and Home) (Rev. 12/03) (Effective January 1, 2004)
This version of the MHCO Rental Agreement is designed for situations where the landlord owns both the space and home. As with other Rental Agreements, this document should be signed by both the landlord and the tenant prior to the approved tenant moving into the home. Remember, the rights of landlord and tenant, and many landlord-tenant procedures are significantly different when the landlord owns both the home and the space. This form incorporates those differences.

MHCO Form 7 - Statement of Policy (Rev. 12/01) (Effective January 1, 2002)
In accordance with Oregon Law, as of July 1, 1992 every landlord who rents a space for a manufactured dwelling or floating home shall provide a written statement of policy to prospective and existing tenants that provides a variety of information. This MHCO form is an outline of the information that the landlord needs to provide. This form is for use with the MHCO Rental and Lease Agreements (MHCO Forms 5A & 5B).

MHCO Form 7A - Rent History Exhibit to Statement of Policy (New. 12/01) (Effective January 1, 2002)
As of January 1, 2002 landlords will be required to provide the rent history of a space in a manufactured home community to prospective resident. This form outlines when it is applicable for the landlord to provide the rent history. The form also provides space to include the previous five years of rent history for a specific space in a manufactured home community.

MHCO Form 7C - Receipt for Statement of Policy
The MHCO Receipt for Statement of Policy is simply an acknowledgement of the undersigned that they received a copy of the Statement of Policy. The receipt is designed to prove that Statement of Policy documents were delivered as required by Oregon Law. Before moving into the community the applicant/tenant may be required by the landlord to sign this form as proof that the tenant has in fact received the Statement of Policy.

MHCO Form 8 - "Straight Talk" About Manufactured Home Park Living (Rev. 3/01)
The 1991 Truth in Renting Act requires that a document called "Statement of Policy" be delivered to all prospective and current manufactured home park tenants by the landlord. "Straight Talk" summarizes important facts with regard to living in a manufactured home community. It outlines in general terms what a tenant may expect with regard to potential rent increases, termination notices, and park closure to name just a few.

MHCO Form 9 - Applicant Screening Charge Notice and Receipt (Rev. 12/01)
This form includes the amount of the application fee and the cost to the landlord of the services. The form also indicates that the applicant has the right to request a free copy of their consumer report from the credit reporting agency.

MHCO Form 10 - Application Denial (Rev. 2/98)
Advises applicant of the reason for denial of their application. In addition it advises the applicant of his/her rights with regard to the Fair Credit Reporting Act and includes the name and address of the reporting agency. This form is given to the applicant upon denial of their application. See ORS 90.295. Remember, the Fair Credit Reporting Act prevents you from telling an applicant what is on their report, you must refer them to the credit check source listed on the screening report.

MHCO Form 10A - Application Denial Letter (New 1/02)
Designed to accompany Application Denial (MHCO Form 10) if the denial is based on credit report. This form is in compliance with the Fair Credit Reporting Act, 15 USC Section 1681, et seq., as amended by the Consumer Credit Reporting Act of 1996.

MHCO Form 11 - Ten Day Notice of Intent to Sell Manufactured Home (On-Site Sale) (Rev. 1/04)
When a tenant decides to sell his/her home the tenant is obligated by Oregon law to provide the landlord with a 10-day notice of intent to sell their manufactured home. The form is in compliance with Oregon law and outlines the tenant's responsibilities to the landlord when selling the manufactured home.

MHCO Form 12 - Partial Payment Receipt
This form is used when a partial payment is rendered. The form allows the landlord to accept partial payment and not waive previous notice. Information provided on the form includes: resident name, amount received, balance due and date balance is to be paid.

MHCO Form 21 - Pet Agreement (Rev. 10/99)
Used depending upon community's policy on pets. If pets are allowed in the community MHCO Form 21 includes type and breed, size, weight, color and name of the pet. The form outlines resident responsibilities with regard to the pet and the fines the resident is subject to if the pet rules are violated.

MHCO Form 22 - RV and Extra Vehicle Storage Agreement
If the community offers recreational vehicle or extra vehicle storage, MHCO Form 22 outlines resident responsibility and liability if the recreational vehicle storage or extra vehicle storage is utilized by the resident. The form requests information on the type of vehicle, license, size etc.

MHCO Form 25 - Temporary Occupant Agreement (Rev. 2/98)
Summarizes the terms of a temporary occupant in the community. Enables landlord to allow a temporary occupant for a specific amount of time with no promise of extension of the residency, protects the landlord from the temporary resident claiming sub-letting and subjects the temporary occupant to the community rules and regulations.

MHCO Form 35A - Manufactured Home Storage Agreement (With Lienholder) (New. 12/01) (Effective January 1, 2002)
This form is to be used when a manufactured home is to be stored on the landlord's property. The agreement is between the landlord and the lienholder of the home. Provides a date by which the home must be sold, clearly indicates the responsibilities of the home owner while the home is in storage on the landlord's property and the monthly storage fee.

MHCO Form 35B - Manufactured Home Storage Agreement (With Homeowner) (New. 12/01) (Effective January 1, 2002)
This form is to be used when a manufactured home is to be stored on the landlord's property. The agreement is between the landlord and homeowner - not the lienholder. Provides a date by which the home must be sold, clearly indicates the responsibilities of the home owner while the home is in storage on the landlord's property and the monthly storage fee.

MHCO Form 36 -Waiver of Abandonment Rights (New. 12/01) (Effective January 1, 2002)
This form is in compliance with ORS 90.675(23) and allows the landlord to sell or dispose of the tenant's abandoned personal property, including but not limited to the manufactured home. Signed by landlord and tenant.

MHCO Form 40 - Door Hanger Notice of Rules Violation (Rev. 10/01)
Use as a reminder to residents that they are in violation of community rules and regulations. Violations listed include yard maintenance, improper storage of property, excessive noise, general appearance of home, violation of park rules on pets, violation of park rules regarding unauthorized occupants. The form is actually a door hanger and can be conveniently placed on a resident's door. Check with your legal counsel and review rental agreements - some rental agreements may not allow "nail and mail".

MHCO Form 41 - 24 Hour Notice of Eviction (Rev. 4/04)
Used when a 24-hour notice of eviction is necessary. Covers a variety of situations allowed in Oregon law to evict with 24-hour notice. Situations include threats to other community residents, damages to property, and unauthorized tenants.

MHCO Form 42 - 72-Hour Notice to Vacate for Nonpayment of Rent (Rev. 12/01)
Designed to be used when rent has not been paid. Provides timelines that are in accordance with Oregon law. Includes late fees that apply, provides for either the notice being sent by first class mail or "nail and mail", and includes the number of previous 72-hour notices that have been sent to the same resident in the past.

MHCO Form 43 - 30-Day Notice to Vacate for Cause (Rev. 10/99)
Used for the termination of a community resident for cause. Form may be personally served or mailed first class mail to the resident. The form also outlines the required timelines for serving the notice and curing the violation and the consequences for repeat violations.

MHCO Form 43A - Thirty Day Three Strikes Notice to Vacate(Rev. 10/99)
Used when a resident has three or more 72-hour notices (MHCO Form 42) within the past twelve months. This is not a notice for nonpayment of rent. This form is used to terminate tenancy of a resident. The form also provides for the notice to be personally served or sent by first class mail as well as the appropriate timelines for the eviction.

MHCO Form 44 - 20-day Notice to Vacate (Repeat Violation Within Six Months) (Rev. 10/99)
After a 30-day notice for cause (MHCO Form 43) has been cured but a violation of the exact same rule or regulation occurs again with six months of the date on the original 30-day notice (MHCO Form 43) the 20-day Notice to vacate is used. The form outlines the appropriate timelines for the eviction and may be personally served or mailed via first class mail.

MHCO Form 45 - Parking Violation
Used for violation of parking by community residents. Includes visitor spaces, handicapped space, parking on the street, parking in more than one space and other contingencies.

MHCO Form 46 - Notice of Disturbance
This form is a formal notification that the cited resident is in violation of noise and nuisance regulations in the community. Advises the resident that the police, sheriff or county health department may be notified if necessary.

MHCO Form 47 - Maintenance/Clean Up Notice
This form is used as a formal notification that the cited home and resident is in violation of community rules and regulations regarding maintenance of the home and surrounding grounds. Typical violations are listed such as improperly installed skirting, lawn not maintained, weeds, painting, general clean up, working on automobiles, unauthorized persons etc.

MHCO Form 48 - Pet Violation Notice (Rev. 10/99)
This form is used as notification that the resident is in violation of the community rules and regulations regarding pets. This notice may be personally served or sent via first class mail.

MHCO Form 49 - Notice of Rent Increase (Rev. 10/97)
Oregon law stipulates how landlord's can increase rent in a manufactured home community. This form is used as the official notification of a rent increase and when the increase will take effect. This form is in compliance with Oregon law.

MHCO Form 50 - Notice of Lease Expiration and Delivery of New Community Documents (New. 12/01) (Effective January 1, 2002)
This notice is used prior to the expiration of a resident's lease. The form outlines the proper timelines required in Oregon Statutes to notify a tenant of the expiration of their lease. The form provides space for landlord to outline changes in the new lease agreement and any applicable changes in the Rules and Regulations. The 2001 version of this form incorporates significant and critical changes as a result of the 2001 Legislative Session.

MHCO Form 50A - Lease Addendum on Rent Increase (Rent Formula) (New. 12/01)
This addendum should only be used where the appropriate box has been checked at section 5 of the MHCO Dwelling Space Lease Agreement. The rent formula provided below is in place of periodic rent increases that the landlord would otherwise be entitled to institute pursuant to ORS 90.600.

MHCO Form 51 - 24-Hour Notice for Entry of Space (Rev. 12/01)
This is the formal notice of entry of a resident's space as stipulated in ORS 90.725.

MHCO Form 52 - Liability Waiver and Release (Rev. 12/01)
This form is designed to limit landlord liability directly/indirectly as a result of providing services to residents in the community.

MHCO Form 53 - Re-Sale Compliance Notice (Rev. 10/99)
This form is used to acknowledge receipt of the resident's Notice of Intent to Sell Home (MHCO Form 11). The form outlines what the resident or purchaser must do to the home, deck, storage/accessory buildings, skirting, awnings, and landscaping/yard in order for the home to remain in the community.

MHCO Form 54 - Emergency Contact Form
This form is in accordance with Oregon law that requires landlords to regularly update community resident records.

MHCO Form 55 - Thirty Day Notice Disrepair or Deterioration (Rev. 12/01)
A manufactured home can be removed from a community due to its condition. This form is the formal notification to the homeowner that specific disrepair and deterioration in the home must be corrected or the home will have to be removed from the community. The notice provides the proper timelines for correcting the necessary repairs and the date when termination and removal date is effective. The notice is designed to be served either personally or via first class mail.

MHCO Form 59 - Addendum Prohibiting Criminal Activity & Disturbances (New 2/98)
This form may be used as an addendum to manufactured dwelling space rental agreement (MHCO Form 5). It specifically prohibits a variety of criminals and drug related activities in the community. Violation of any of the provisions of this form may result in termination of the resident's tenancy.

MHCO Form 70 - Addendum to the Rental/Lease Agreement (Regarding Lot Size) (New 6/00)
Used by the landlord as an addendum to the manufactured dwelling space rental/lease agreements (MHCO Form 5A & 5B). This form acknowledges that the tenant has been shown the appropriate lot lines and understands the approximate total square feet of the property to be rented.

MHCO Form 71A - Addendum to the Rental/Lease Agreement for Age 55 & Older Communities (Rev. 12/01)
This addendum may be used with the Rental/Lease Agreement. The form specifies that the respective community is an age 55 or older housing community under the Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended 42 U.S.C. 3601-3619) and the Housing for Older Persons Act of 1999 (Rule L 104-76, 109 Stat. 787).

MHCO Form 71B - 55 & Older Community Occupancy Determination and Age Verification (New 6/00)
Can be used to verify age in a 55 & Older Community. Form includes space for name and address of the community, tenant and occupant names and a checklist of the documents that may be used to verify age.

MHCO Form 71C - 55 & Older Community HUD Verification of Occupancy Survey (New 6/00)
This form may be used in verifying occupancy in a 55 & Older Community. The survey is taken to comply with the Housing for Older Persons Act of 1995 (HOPA) and the 1999 rules for implementing that act provided by the Department of Housing and Urban Development.
